Terms of Use

1. Preamble is an online magazine for the specialized retail community published by Cegid, available at The magazine aims to review the major issues in the retail industry and help retail chains in France and in the world to anticipate tomorrow’s challenges by providing stories, catching up with the news and sharing expertise and best practices.

2. Definitions

For purposes of the Terms of Use, the following terms shall have the meaning set forth below:

  • “comment” means all items published by the user on the areas reserved for this purpose under their responsibility.
  • “content” means, in the singular or plural form, all items (text, image, video/photo) published by Cegid on the site, including but not limited to ads, comments, news, events, recommendations…
  • “party”: means in the singular form either Cegid or the user, and Cegid and the user together in the plural form;
  • “site” or “website”: means the website accessible at URL;
  • “user” means generally any person using the site.
3. Purpose

6. Contents

The information provided by Cegid is for information purposes only and users are urged to perform additional and personalized analysis as applicable.

Cegid will strive to include information as accurate as possible on the site. However, it cannot be held responsible for omissions, inaccuracies ion or timeliness in respect of the information provided by it or third party partners.

Users agree that when asked to provide information about them, the data they give must be complete, accurate and updated.

7. Newsletter Subscription

Users can choose to register to receive the Stores and Stories Newsletter by clicking on the “Subscribe” tab.

The newsletter will be sent to the email address provided by the user in the subscription form.

User can unsubscribe at any time by clicking on the unsubscribe link included in each email sent.

8. Intellectual Property

Nothing in these Terms of Use is intended to transfer any intellectual property rights whatsoever owned by Cegid to the users.

The site, and each and every of the individual items thereof, including but not limited to texts, images, graphics, logos, icons, sounds, software, files, are the exclusive property of Cegid or any third party licensors, as the case may be.

Any total or partial reproduction, performance, modification, publication, adaptation of any items composing the site, for any purpose and in any manner whatsoever, without Cegid’s prior written authorization is strictly forbidden and shall constitute an infringement.

The foregoing also applies to the databases appearing on the site for which Cegid is the producer, which are protected by the French Intellectual Property Code.

The distinctive signs of Cegid and its partners, such as domain names, trademarks, trade names and logos appearing on the site are also protected by the French Intellectual Property Code.

Any total or partial reproduction of such distinctive signs from the site without Cegid’s express authorization is therefore strictly forbidden by the French Intellectual Property Code.

Users agree that they shall not act in any manner that may directly or indirectly infringe the intellectual property rights of Cegid.

Users further agree to take all measures necessary for the protection of such rights against any third party, in particular by maintaining all proprietary notices displayed on all data, information and more generally on the items available on the website or made available by third parties.

9. Personal Data

Cegid, as the data controller, processes personal data with the following main purposes:

  • manage subscriptions to newsletters;
  • manage answers to requests sent via the contact form;
  • analyze the website traffic through cookies as described below.

All fields marked with an asterisk in the newsletter registration form must be completed; otherwise, the newsletter subscription might not be possible.

The data collected are required for the purposes of the processing mentioned above. The personal data relating to users are intended for the internal use of Cegid and its partners.

Pursuant to the French Data Protection Act No. 78-017 of 6 January 1978, users have a right to access and rectify personal data relating to them, to object on legitimate grounds to their processing and object to their use for direct marking purposes. They can exercise their rights by sending a written and signed letter containing their request, together with a copy of an identity document showing their signature, and indicating the address to which the reply should be sent.

Users must comply with the provisions of the French Data Protection Act and any violation shall be punished by criminal penalties.

10. Use of the site
10.1 Access the site

Access to the website is free and is not subject to the prior creation of an account.
Users acknowledge that they have the skills and equipment required to access and use the site.

Access to the site is not subject to the payment of any financial consideration. However, costs (including Internet subscription) to access the site must be borne by the users.

Users of the site acknowledge that they have checked that the configuration they use is virus-free and in perfect working condition.

Users shall not act in any manner that may damage or otherwise compromise the IT security of the website or other users.

Users agree not to interfere with or disrupt the normal operation of the site.

10.2 Maintenance and update

While Cegid makes every effort to provide users with information and/or tools that are available and verified on the site, it makes no representations or warranties that they will be error-free, uninterrupted or virus-free.

This site should normally be accessible to users at all times. However, Cegid cannot be responsible if the site is voluntarily or involuntarily made unavailable.

Cegid may interrupt the site for technical maintenance purposes and in such case it will endeavor to inform users beforehand of the date and time of such maintenance.

Cegid is not liable for damage of any kind arising out of or in connection with the changes and/or temporary unavailability of the website.

Cegid reserves the right to complete or modify the site at any time according to the evolution of technology and will inform users by any means.

However, Cegid cannot be responsible for:

  • disturbance in the use of or inability to use the site;
  • temporary or total unavailability of all or part of the site, of the user’s account or of documents and content posted on the site;
  • difficulty related to the response time or poor performance of any site;
  • difficulty in transmitting information on the site;

10.3 User warning

Any access to a prohibited area will be considered a fraudulent access within the meaning of the French Penal Code.

Users must assume that all data found when accessing a prohibited area are confidential and they agree not to disclose them.

Users agree not to use devices or software of any kind that would result in disrupting the proper functioning of the site.

11. Limitation of liability

Cegid and its hosting provider (Aressy & Associates) cannot be held liable for direct and indirect damage that may be caused to user hardware when accessing the site.

In no event shall Cegid be liable for any damage that may be caused by the use of this site. Consequently, users acknowledge that they use the site under their sole responsibility. They shall not, intentionally or not, use the site in violation of any national or international laws or regulations and any legal instruments or any other binding rules.

Comments posted by users must be consistent with the laws and/or regulations in force and the provisions of these Terms of Use.

User shall not infringe the rights of third parties or harm the reputation of Cegid or the site.

Interactive spaces (comments) are available to users. Cegid reserves the right to remove without prior notice any comment posted in this space that would violate the law applicable in France, particularly in respect of data protection. If necessary, Cegid also reserves the right to sue users in civil or criminal courts, particularly for messages that are:

  • unrelated to the object of the site, incomplete or not in keeping with the spirit of the site;
  • contrary to the moral and/or property interests of Stores and Stories;
  • contrary to applicable laws and regulations;
  • defamatory, insulting, offensive, abusive, obscene, false, misleading, aggressive, threatening, profane, derogatory, disparaging, libelous, indecent or otherwise affecting the image or reputation of a brand, an individual or an entity in any manner whatsoever;
  • containing words, statements and/or images that may undermine respect for the human person and their dignity;
  • showing religious or political beliefs;
  • aiming to divert the purpose of the site for propaganda, proselytism.

Users warrant that the comments they post:

  • Do not infringe the intellectual property rights of third parties, a signboard, a trade name, a domain name or a telematics server name;
  • Do not conflict with the rights of individuals on their personality, privacy, image and property and/or data protection law, competition law, or consumer law (including unfair trade practices, advertising and regulated practices, announcements of price reductions).

As a rule, users are encouraged to exercise discretion and caution when posting comments.

Such consent can under no circumstances be regarded as an implied affiliation agreement.

14. General provisions
14.1 Headings

Headings are included for convenience only and in case of difficulty of interpretation between the section headings and the content of any of the sections, headings shall be declared null and void.

14.2 Severability

If one or several provisions of these Terms of Use were to be held invalid or so declared by a law, a regulation or a final decision having res judicata effect rendered by a court having proper jurisdiction, the other provisions shall remain in full force and effect.

14.3 Rules of evidence

The electronic acceptance of these Terms of Use will have between the parties the same probative value as a written acceptance.

The IT records will be stored in the computer systems under reasonable security conditions and will be considered as evidence of the communications between the parties.

15. Governing law

These Terms of Use shall be governed by French law.

French law shall apply to both form and substance, notwithstanding the place of performance of the essential or ancillary obligations.
